One category of membership programs owned and operated by Vertrue and Adaptive Marketing are credit monitoring services. With these services, Vertrue and Adaptive Marketing entice a consumer to join by offering a free credit report, but in fact unknown to the consumer, he is in fact signing up for an expensive membership program with a reoccurring monthly charge.
It is difficult to determine the exact number of credit monitoring services owned and operated by Vertrue and Adaptive Marketing, but research seems to suggest that Vertrue and Adaptive Marketing own FreeScore, Credit Diagnosis, Privacy Matters and Credit Adapter.
This class action investigation is based on consumer reports that consumers believe that they are receiving a free credit report, but in fact are unknowingly signing up for on of Vertrue and Adaptive Marketing's credit monitoring membership. Consumers report that Vertrue and Adaptive Marketing are:
(1)failing to disclose properly that there is a monthly charge for the service;
(2) failing to disclose that the monthly charge is reoccurring;
(3) failing to properly disclose that a consumer can cancel the membership during the "7 day free trial";
(4) failing to properly disclose that a consumer can cancel during the membership term; and
(5) failing to properly disclose how a consumer can cancel.
