Investigation and pending class action lawsuit against Toshiba America Consumer Products, L.L.C. ('Toshiba') is a subsidiary of Japan-based Toshiba Corporation. Toshiba manufactures a full line of home entertainment products, including flat panel TV, rear and front projection and direct view televisions, home theater projectors, combination products and portable devices.
This class action lawsuit alleges that Toshiba marketed some of its models of high definition televisions as 1080p televisions, even though the televisions could not receive a 1080p signal from any available source. Additionally, Toshiba did not and has not disclosed in its advertising or marketing materials the inability of the televisions to accept a 1080p signal. Consumers relied on Toshiba's assertions and paid a premium price for the 1080p models.
This consumer class action lawsuit is on behalf of persons or entities located within the United States who purchased Toshiba televisions which were described by Toshiba as "1080p" but cannot accept a 1080p signal from any available source. The class action alleges that Toshiba marketed some of its models of high definition televisions as "1080p" televisions, even though the televisions could not and still cannot receive a true 1080p signal from any available source. As a result of Toshiba's deceptive marketing and failure to disclose the televisions' inability to receive a 1080p signal, the class action lawsuit alleges that consumers paid more for Toshiba's so-called '1080p' televisions than they were actually worth.
