The class action lawsuit is based upon T-Mobile customers' complaints that they have been charged and paid undisclosed roaming rates for voicemail message notifications and unanswered calls received while traveling outside of the United States.
As set forth in the class action complaint, T-Mobile charges, in the absence of sufficient prior disclosure, up to $3.98 for every voicemail message notification left on the customers' mobile phones while the customers are traveling outside of the United States, even if the customers do not check their voicemail. These charges appear on customers' bills as calls to Santa Barbara, California at telephone number 805-637-7249. If the customers do check their voicemail, they are assessed an additional per minute roaming charge. T-Mobile also charges, in some instances, up to $3.98 for every unanswered call received while the customers are traveling outside the United States.
