Investigation and pending class action lawsuit against T-Mobile claiming T-Mobile does not allow customers to opt out of text messaging services, which can lead to unwanted charges.
The class action lawsuit alleges that customers who do not want the text-message service have no way to avoid being charged for text messages, including spam or advertising messages. Unlike other wireless providers, T-Mobile does not allow customers to disable text messaging functions. According to the consumers, under T-Mobile's plan, incoming text messages cannot be rejected or dismissed nor can the messages be avoided by turning the phone off. Customers only available solution is to pay for the unwanted service or to switch providers, which can trigger early termination fees.
