The class action lawsuit alleges that customers who do not want the text-message service have no way to avoid being charged for text messages, including spam or advertising messages. Unlike other wireless providers, T-Mobile does not allow customers to disable text messaging functions. According to the consumers, under T-Mobile's plan, incoming text messages cannot be rejected or dismissed nor can the messages be avoided by turning the phone off.
