Investigation and pending class action against Trex Company, Inc., claiming Trex, the nation's largest manufacturer of wood-alternative decking, sells flawed products and fails to live up to its guarantee when its products fail.
n the class action lawsuit, a Washington homeowner claims his two-year old deck began degrading, cracking and rotting and is now unusable and unsafe for his family. The homeowner claims Trex offered to replace the damaged boards but refuses to pay for associated labor costs. In exchange for the new materials, Trex asks for a signed release freeing the company from further liability. The lawsuit alleges Trex's warranty documents violate the federal Magnuson-Moss Warranty Act, a consumer protection regime.
Trex faced a similar lawsuit in 2000 that settled. The settlement included a provision that says Trex will pay for replacement costs in addition to the new product.
