Unum and Paul Revere might have fraudulently charged California policy holders useless "own occupation" and "residual disability" premiums with total disability policies.

Investigation and pending class action against against Unum, Provident Life & Accident Insurance Company and Paul Revere Life Insurance on behalf of current and former California policyholders concerning the sale and adjustment of individual "own-occupation" total disability policies and the "residual disability" policies or riders Unum and Paul Revere sold in conjunction with the total disability policies.

On October 3, 2005, the California Insurance Commissioner settled claims with Unum and Paul Revere. Unum and Paul Revere agreed to cease and desist from, among other things, their standardized claims handling practices, and agreed to implement a process by which certain policyholders who previously had disability claims denied could have claims reassessed by Unum and Paul Revere. Effectively, this settlement afforded relief to those California residents that were wrongfully denied benefits.

The settlement agreement with the California Insurance Commissioner did not provide relief to those policyholders who paid premiums for many years for disability coverage under false pretenses, during which time it is alleged that defendants concealed that they never intended to provide the coverage that was required under the policies. Nor did the settlement agreement provide relief to policyholders who purchased the residual disability coverage that it is alleged policyholders never needed in the first place. This state-wide class action is brought on behalf of the California policyholders who did not have claims denied, but who paid premiums to Unum and Paul Revere under false pretenses between 1994 and October 3, 2005, while Unum and Paul Revere actively concealed their scheme, and seeks the return of premiums paid for "own-occupation" total disability policies and the "residual disability" policies or riders sold by Unum, Provident and Paul Revere.
