Constellation Energy Group may have breached its fiduciary duties to current and former employees who bought Constellation stock for their company sponsored retirement plan.
This is an investigation and pending ERISA class action complaint against Constellation Energy Group on behalf of all persons who were participants in or beneficiaries of:
(1) the Constellation Energy Group, Inc. Employee Savings Plan; and
(2) the Represented Employee Savings Plan for Nine Mile Point.
This ERISA class action includes all current and former employees and all beneficiaries that held Constellation stock in their retirement account between January 30, 2008 and the present.
The class action complaint alleges that during this time period, Constellation breached its fiduciary duties to the class members by: failing to prudently and loyally manage the Plans' assets; failing to monitor fiduciaries; failing to provide complete and accurate information to the Class; and participating in a breach by a non-fiduciary.
