West Telemarketing operates call centers for third parties. West employes people to work at home to receive inbound calls and titles these workers as "Contract Home Agents."
Former employees of West Telemarketing allege that West Telemarketing improperly classified Contract Home Agents as "independent contractors" when they should properly have been classified as "employees". Consequently, Contract Home Agents did not always receive the equivalent of the federal minimum wage for employees, and Contract Home Agents worked more than 40 hours during some weeks and were not paid the federally required overtime rate of pay for employees.
