Investigation and pending class action lawsuit against ClientLogic on behalf of call center employees from ClientLogic's Buffalo, N.Y., call center facility.
The call center workers allege that they were required to perform work outside their scheduled shifts, for ClientLogic's benefit, without being paid regular pay or overtime.
In investigating the claims against ClientLogic and other companies that run call centers, including TeleTech, JP Morgan Chase, GEICO, and HSBC, SSH and O&G have found requiring "off the clock" work to be a common practice in the call center industry. This requirement violates the Fair Labor Standards Act (FLSA) and the State Labor Laws which require ClientLogic to pay its hourly workers time and a half for all hours that they work beyond forty hours in a workweek -- including time that they work outside of their scheduled shifts.
This class action lawsuit seeks to force ClientLogic to pay thousands of employees the wages that they earned. The workers are seeking class action status.
ClientLogic's call center customers include Sony, Microsoft and DirectTV. ClientLogic runs call centers in Buffalo, N.Y.; Kenmore, N.Y.; Tonawanda, N.Y.; Andalusia, Ala.; Hamilton, Ala.; Winfield, Ala.; Milford, Del.; Lake City, Fla.; Bogalusa, La.; Starkville, Miss.; Las Vegas, Nev.; Bloomfield, N.J.; Clifton, N.J.; Fairlawn, N.J.; Weehawken, N.J.; Albuquerque, N.M.; Asheville, N.C.; Columbus, Ohio; Bartlesville, Okla.; Norman, Okla.; Kingstree, S.C.; Nashville, Tenn.; Oak Ridge, Tenn.; Dallas, Texas; Port Arthur, Texas; and Huntington, W.Va.
