Investigation and pending class action lawsuit against Dell on behalf of current and former consumer sales representatives (CSR) in a wage and hour collective.
The class action lawsuit alleges that Dell violates federal and state wage and hour laws by failing to accurately record all time worked and failing to pay earned wages and overtime. Examples of the unlawful practices claimed include:
(1) requiring employees to work "off the clock" by not paying for work performed pre-shift, post-shift, and over unpaid meal breaks;
(2) utilizing an inherently inaccurate time-keeping system called "Kronos"; and
(3) improperly calculating overtime using a "half-time" overtime rate.
On July 10, 2008, the Court conditionally certified the claims of CSR that were filed under the Fair Labor Standards Act. The Court's certification order applies to current and former full-time CSR at Dell's call centers across the country, and who worked for Dell between February 8, 2004, and the present.
The Court's Order did not include part-time CSR or those employees who worked in the SRS queue.
