This antitrust class action lawsuit alleging that the nation's largest manufacturers of construction flat glass violated the antitrust laws by fixing prices and imposing coordinated energy surcharges on their customers. Defendants' price fixing has allegedly caused their customers to be overcharged for their flat glass purchases.
Defendants met with each other to discuss pricing levels and practices and agreed to fix prices of Construction Flat Glass sold in the United States: (1) they agreed to raise prices to customers in a coordinated fashion; and (2) they agreed to implement identical "energy surcharge" programs and charge identical energy surcharges to their customer so as to raise the price of Construction Flat Glass. In implementing their conspiracy, Defendants engaged in practically simultaneous conduct, unsupported by existing economic and market conditions; demonstrating that their activities were the result of prior knowledge and coordination.
