Investigation and pending antitrust class action against the five U.S.-based Class I Railroads: BNSF Railway Company; CSX Transportation, Inc.; Kansas City Southern Railway Company; Norfolk Southern Railway Company; and Union Pacific Railroad Company.
This antitrust class action litigation alleges that the railroads engaged in price fixing in violation of the Sherman Act by fixing the levels of rail freight fuel surcharges imposed on rail freight shippers beginning in approximately July of 2003.
The Railroads are alleged to have fixed prices, among other means, through the Association of American Railroads, a trade association based in Washington, D.C.
